Veaceslav Platon against the FISC. How many millions is he "fighting for" in court

The Supreme Court of Justice (CSJ) rejected the request submitted by the defenders of Veaceslav Platon, in which they requested the transfer of the "Platon vs Principal State Fiscal Inspectorate" case to another court of equal rank. Thus, after six years, the case returns to the Chisinau Court of Appeal, for examination of the appeal against the decision of the trial court.

As a reason for transfer, Veaceslav Platon, represented by lawyer Ion Crețu, cited the fact that the judicial panel, represented by Ghenadie Mâra, Grigore Dașchevici, and Angela Bostan, would have a biased attitude towards the participants in the trial. The supreme court, however, decided that the defense arguments of Veaceaslav Platon are not conclusive, and no deviations were found in the trial process.

On September 5, 2016, Veaceslav Platon filed a request regarding the annulment of the administrative acts by which the FISC calculated and collected his income tax in the amount of 17,255,917.56 lei, for the year 2015, and they applied to him late increases calculated within the fiscal control in the amount of 574 967.17 lei.

By the decision of December 28, 2016, of the Chisinau Court, the Râșcani office, was rejected as unfounded the action filed by Veaceslav Platon. By the decision of July 6, 2017, the Chisinau Court of Appeal rejected the action as well and the decision of the first instance was upheld.

On March 31, 2021, the Supreme Court of Justice accepted the appeal filed by Veaceslav Platon. The decision of the Chisinau Court of Appeal was overturned and the case was returned for retrial, in another judicial panel.

On December 27, 2021, prosecutors filed a criminal case against Veaceslav Platon. He is charged with tax evasion for over 7 million lei, in the period 2012-2015. The file was filed based on a self-referral report drawn up in September by prosecutor Elena Ceruţa, who a few months earlier withdrew the charges against Platon in the bank fraud case, in which the businessman had been irrevocably sentenced to 18 years in prison.

"For unclear reasons, the previous management of the Prosecutor's Office did not order the examination of the prosecutor's report, as provided by the imperative provisions of the Code of Criminal Procedure, but opted for the transmission of the prosecutor's referral act as simple information to the investigative bodies," it was stated in a statement from the General Prosecutor's Office.

The document states that after the detention of Alexandr Stoianoglo on October 5, 2021, the circumstances of the declination of persecution in the Platon file were verified, and the self-referral report from September 2021 regarding tax evasion of over 7 million lei was also detected. Thus, the document was registered in the Criminal Record Register of the Prosecutor's Office for Combating Organized Crime and Special Cases.

Veaceslav Platon left for London shortly after the snap elections in Parliament in the summer of 2020. He faces several criminal charges.
